Trump Seeks Supreme Court Rehearing on Birthright Citizenship Ruling

President Donald Trump said Wednesday that he will ask the U.S. Supreme Court to rehear a case in which the justices rejected his executive order limiting birthright citizenship. The June 30 ruling held that children born in the United States are automatically citizens under the Fourteenth Amendment’s Citizenship Clause.

Trump’s executive order, signed Jan. 20, 2025, would have denied citizenship documents to certain babies born in the U.S. if their parents were undocumented immigrants or had entered the country illegally. The policy was set to take effect 30 days after the order was issued, but the Supreme Court ruled against it.

Requests for rehearing at the Supreme Court are rarely granted. According to Georgetown University law professor Steven Vladeck, the court has not agreed to rehear a fully argued case since 1965. The last time it reversed its own decision after rehearing an argued case was in 1956.

In a post on Truth Social, Trump claimed that signs and billboards near the southern border and in Mexico were advertising birthright citizenship services, including deliveries starting at $4,000. He argued that such practices amounted to a scam and said American citizenship “is not for sale.” Trump stated that he would seek a rehearing immediately and criticized the court’s decision.

The birthright citizenship case has drawn public attention, including demonstrations outside the Supreme Court during oral arguments in April 2026. Protesters displayed messages supporting the principle that those born in the United States are citizens.

Trump is also asking the Supreme Court to reconsider its recent refusal to hear his appeal in a separate civil case involving writer E. Jean Carroll. In that case, a New York jury found Trump liable for sexual abuse and defamation. A federal judge ordered that damages and accrued interest be distributed to Carroll despite Trump’s pending request.
