Trump administration stops taxpayer funding for illegal immigrants in higher education

The U.S. Department of Education announced a significant policy change regarding taxpayer-funded postsecondary education benefits. Secretary of Education Linda McMahon stated that these benefits will now be restricted to American citizens and legal residents, effectively barring illegal immigrants from accessing federal public benefits related to postsecondary education programs.

This decision rescinds a Clinton-era "Dear Colleague" letter that had previously allowed certain non-qualified illegal immigrants to access these benefits. According to the Department of Education, the prior guidance mischaracterized the Personal Responsibility and Work Opportunity Reconciliation Act (PRWORA) of 1996, which does not make distinctions between federal benefit programs based on the type of assistance provided.

The new policy will impact a range of educational programs, including career, technical, and adult education, limiting eligibility to individuals who are legally present in the United States. Secretary McMahon emphasized that taxpayer-funded programs should primarily benefit American citizens, stating, "Under President Trump's leadership, hardworking American taxpayers will no longer foot the bill for illegal aliens."

The enforcement of this policy is set to begin on August 9, 2025. The Department of Education's decision reflects a broader emphasis on ensuring that federal resources are allocated to those who meet legal residency requirements, aligning educational funding with existing federal laws.
