A federal judge in New York ordered the Trump administration to remove three taxpayer-funded advertisements from government websites and social media while a legal challenge proceeds. The order also requires the government to cancel arrangements for third-party distribution, including through the super PAC MAGA Inc.
The advertisements are titled “$5,000 to Americans,” “Every Democrat Voted Against No Tax on Tips,” and “Cost of Socialism.” The first promotes President Donald Trump’s claim that every American would receive $5,000 if Republicans retain control of Congress in the upcoming election.
U.S. District Judge Jennifer L. Rochon issued the ruling during a hearing on whether to expand a temporary restraining order she had entered two weeks earlier against other administration advertisements. She directed officials to remove the three ads immediately. A government lawyer said he could promptly notify those responsible.
The plaintiffs, a coalition that includes the nonpartisan watchdog Common Cause, sought the removal of at least 13 advertisements. Rochon declined to block the others for now, saying the president’s office may inform the public about its policies, explain them and respond to criticism. She said the coalition’s proposed restrictions were too broad in several respects.
The White House has described the ads as public service announcements similar to those issued by previous administrations. The plaintiffs argue that the ads differ because they do not help people access specific government programs. White House spokesperson Lauren Bis criticized the ruling, calling it a “lawless order” that prevents the administration from sharing “patriotic videos.”
Rochon said leaving the three ads in place could cause irreparable harm before the court reaches a final decision. She noted that further evidence could lead her to restore those ads or restrict additional ones. The litigation remains ongoing.
