Florida hospital files lawsuit to evict long-term patient who won't leave

Tallahassee Memorial HealthCare (TMH) has initiated legal proceedings against a former patient who has remained in the hospital for five months despite being medically cleared and discharged. The hospital filed its complaint earlier this month, stating that the woman was formally discharged on October 6, 2025, yet continues to occupy an inpatient room.

According to the complaint, TMH staff made numerous attempts to facilitate the patient’s discharge, including coordinating with family members and providing non-emergency medical transportation to help her secure necessary identification. Hospital officials assert that the patient's prolonged stay is straining their limited resources and obstructing care for other patients in need of acute attention.

TMH emphasized in its filing that the continued occupancy of the inpatient bed by the former patient is preventing the hospital from accommodating other individuals requiring medical care. As of March, the woman had not vacated her room, prompting TMH to seek a court order that would compel her to leave. The order would also authorize the Leon County Sheriff’s Office to assist in her removal if necessary.

A court hearing regarding this matter is scheduled for March 30. While it is unclear how frequently hospitals pursue legal action against patients who refuse to leave after discharge, TMH has indicated that it is unable to provide further details due to the ongoing legal proceedings. This case raises questions about the challenges hospitals may face when patients remain in care beyond their medical necessity.
